It is a congressional maxim that 'no citizen should any more in taxes than he is legally obligated to pay'. There used to be (prior to the 87 Tax Act) a number of ways to legally avoid taxes. These methods were called "Tax Shelters" and they worked well. So well, in fact, that they were legislated out of existence by that Congress that is always looking out for us. For all practical purposes, there are only two tax shelters left. 1. Real estate. Because of a little item called depreciation, you can make an actual profit but show a taxable loss on paper. This is the big attraction for real estate. That, along with the 1031 Exchange (a way to postpone tax when your deeprreciation runs out). The tax people would probably like to kill it but are afraid of the resulting uproar. Believe it or not, there was once a move afoot to eliminate mortgage expense as a tax deduction. It created such a furor that the politicos never mentioned it again. 2. A bona fide BUSINESS. Note the "bona fide". The business mus have a legitimate business intent. The IRS has killed a lot of so-called businesses because no 'business intent" could be satisfactorily established. You see, a business (properly established) can deduct just about every expenditure it makes. How would you like to be able to deduct most of your expenditures? Sure you would.
